The constitution was written with each part
having a meaning. Those who voted on
the constitution, whether they voted for or against, knew the meanings of each
article and amendment. There was great
debate prior to voting, much of which was recorded. By voting they agreed to accept the meanings. The meanings were not to be changed. They provided the avenue for change in the
Amendment process and calling of a Constitutional Convention.
Supreme Court judges were not to change the
meaning of the constitution when looking at laws rather apply the known
definitions. We all know there where
some opposed to this or that but they accepted what was laid before them by
participating in the vote for the constitution and amendments. So, when one say’s “yes but so and so was
opposed to that principle” that is not germane to the argument of
constitutionality, by voting they accepted the intended meaning.
The reason the Constitution is a Living and
Breathing Document is the Amendment Process and Constitutional Convention, NOT
changing the meaning of words within the document!
